2.2 The Promotion of Access to Information Act 2 of 2000 – This act sets forth your rights in relation to the information we have about you as well as when and how you may request access to that information.

2.3 The Protection of Personal Information Act 4 of 2013 – Regulates the processing of your personal information.

2.4 In the event of any dispute arising between the parties on any matter relating or arising out of this Privacy Policy, it will be resolved by our Customer Relations Department.

3.1 Zella Skincare (Pty) Ltd is required to take all reasonable steps to protect your personal information and for the purposes of this clause, “personal information” is defined as detailed in the Protection of Personal Information Act 4 of 2013.

3.3 We primarily use your personal information only for the purpose for which it was originally collected. We will use your personal information for a secondary purpose only if such purpose establishes a legitimate interest for you or for us and is closely related to the original purpose.

3.4.1 Required by law, instructed by you and/or our profession;

3.4.2 To greet and welcome you when you access the website;

3.4.3 To inform you of facts in respect of your access and use of the website – If you have agreed to this;

3.4.4 To inform you of competitions and promotions offered by Zella Skincare – If you have agreed to this;

3.4.5 Communicate requested information to the user;

3.4.6 To confirm your identity when you proceed with a transaction on the website; and

5. Your rights

5.1 Rights of access, rectification and erasure, restriction of processing, data portability, and to object.

5.2 At any time you may request that we delete your information or refrain from using it. If the information is needed in order to complete a transaction, we will not be able to complete the transaction. If we are required by law to keep the information, we will not be able to delete it.

 5.3 You may unsubscribe to any of our electronic material by clicking on the unsubscribe option of by contacting us. In such an event, we will remove your information in a secure way.

5.4 You have the right to lodge a complaint with a supervisory authority regarding the processing of your personal data. 


6. Security

6.1 A user that tries to deliver any harmful code to the website or tries to obtain unauthorised access to any page on the website will be prosecuted. 

6.2 Zella Skincare will claim civil damages from the user if it suffers any damage or loss. 

6.3 You undertake that your login name and password will be utilised for your own personal use and that you will not reveal it to any third party. 

6.4 You consent to Zella Skincare taking all reasonable steps available to ensure the security and integrity of the administration office and website.

6.5 We undertake that we have taken reasonable precautions to ensure the credit card handling that is conducted to receive payment for the products sold.

6.6 We have no access to any confidential information in respect of your payment method. 

6.7 Only our bank partner will access confidential information including – your credit card number, CVV, expiry date.

6.8 We cannot be held liable for security breaches occurring on the users electronic device, such as a computer or phone, which may occur due to the absence of adequate virus protection software or spyware that the user may have inadvertently installed on their device.

 

7. Hosting 

7.1 Our website is hosted by Godaddy. They provide us with the online platform that allows us to sell our products and services to you. 

7.2 Your data is stored through their data storage, databases and the general hosting application.

7.3 They store your data on a secure server behind a firewall.

7.4 By consenting to our Privacy Policy, you consent to the use of your information by our host.

 

8. Payment

8.1 If you choose a direct payment gateway to complete your purchase, then DPO Group stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard PDI-DSS.

8.2 Your purchase transaction data is stored only as long as is required to complete your purchase transaction. After it is complete, your purchase transaction information is deleted. 

8.3 All direct payment gateways adhere to the standards set by PCI-DSS as managed by PCI Security Standards Council, which is a joint effort of brands such as MasterCard and Visa.

8.4 PCI-DSS requirements help ensure the secure managing of credit card information by our website.

 

9. The use of cookies

10.7 Complaints, concerns, claims and/or questions in respect of third party products must be directed to the third party.

 

11. User comments, feedback and other submissions

11.1 If, at our request, you send specific submissions – for example a competition entry or without a request from us you send creative ideas, proposals, suggestions, plans or other materials, whether online, by postal mail, by email or otherwise – for example comments, you consent that we may, at any point, without restriction, edit, copy, distribute, publish, translate and otherwise use in any form any comments that you forward to us.
